Alina Habba has resigned as New Jersey's top federal prosecutor. This decision was prompted by a court battle that challenged her eligibility to hold the office.

Official Departure

US Attorney General, Pam Bondi, announced the prosecutor's departure on Monday. She commented that the court's "flawed" ruling made it unworkable for Habba to effectively run her office.

"Do not interpret following the order as giving up," she declared. "The effort will now stretch across America."

Judicial Challenge

The departure was triggered by a judicial panel determined that she had been acting without proper authority as the federal prosecutor. This decision is expected to impact numerous legal proceedings in the Garden State.

The judicial panel said that a acting appointment that bypassed the advice and consent of the Senate violated the federal law governing appointments.

Bondi said that she will remain at the DOJ as a senior adviser. She will challenge the decision of the court's action, with hopes of a overturned decision.

On a social media platform, the Attorney General contended that the judiciary "cannot be permitted to override the President's choice of prosecutors responsible for carrying out the primary duty of the administration of criminal prosecution."

Performance in Office

The attorney general commended Habba's record and said that during her run, the city of Newark saw a one-fifth decrease in offenses. She also stated that the city of Camden recorded its initial homicide-free summer since 1974 without a homicide.

Background and Previous Role

The 41-year-old attorney, first joined the former president's legal defense in recent years. Subsequently, she acted for the former president in his New York criminal case in 2024, which resulted in his guilty verdict on dozens of charges of document fraud.

Before Habba took on the role of US Attorney, Trump had announced he was naming her as his senior adviser during his second administration, calling her as a steadfast ally and a relentless legal advocate.
